China published a regulation on July 9 concerning the supervision and administration of private investment funds. The regulation aims to encourage the standardized and healthy development of the private investment fund industry, better protect the legitimate rights and interests of investors, and encourage the industry to further play a role in serving the real economy and promoting scientific and technological innovation.

近年来，我国私募基金行业发展迅速，在提升直接融资比重、支持科技创新和家当转型升级、知足居民财富管理需求等方面，发挥着越来越主要的浸染。数据显示，截至2023年5月，在中国证券投资基金业协会登记的私募基金管理人2.2万家，在基金业协会备案的私募基金15.3万只，基金规模21万亿元旁边，居环球前列。长期以来，私募股权基金的监管上位法依据不敷，对其规范紧张依赖部门规章、规范性文件以及自律规则，监管司法依据和手段相对欠缺。随着成本市场改革深化以及行业发展的客不雅观哀求，到了须要重视并纳入上位法调度的阶段。
将于2023年9月1日起施行的《私募投资基金监督管理条例》是我国私募投资基金行业首部行政法规。条例的出台，有利于完善私募基金监牵制度，将私募投资基金业务活动纳入法治化、规范化轨道进行监管，对私募基金行业规范康健发展、戒备化解风险具有主要积极意义。条例规定，将左券型、公司型、合资型平分歧组织形式的私募投资基金均纳入适用范围，明确私募基金管理人和托管人的责任哀求，规范资金召募和投资运作，特殊规定国家对创业投资基金给予政策支持，强化监督管理和法律任务。
